Corolla Social Driver Sweepstakes #418 (the “Sweepstakes”) is sponsored by Every
Day with Rachael Ray Magazine and www.allrecipes.com,
wholly owned subsidiaries of The Reader's Digest Association, Inc. (Reader's
Digest) and Toyota Motor Sales, 1. ELIGIBILITY:
Sweepstakes open only to legal residents of the United States, its territories
and possesions who are physically located and
residing therein, and who are age 18 or older and not a minor in their state of
primary residence at time of entry All
employees of Toyota, Reader's Digest , InfoUSA
(“Administrator”), and all of their respective parent, subsidiary and affiliate
companies, distributors, dealers, dealer advertising associations, advertising
and promotion agencies and any other agency that provides services in
connection with this Sweepstakes, as well as the immediate family (spouse,
parents, siblings and children and their respective spouses, regardless of
where they reside) and household members of each such employee, whether related
or not, are not eligible to participate in this Sweepstakes. This Sweepstakes is subject to all applicable
federal, state, and local laws and regulations.
Void where prohibited.
Participation in this Sweepstakes constitutes entrant's full and
unconditional agreement to these Official Rules and Sponsors and
Administrator's decisions, which are final and binding in all matters related
to this Sweepstakes. Winning the prize
is contingent upon fulfilling all requirements set forth herein. 2. HOW TO ENTER:
To enter simply go to COROLLASOCIALDRIVER.COM. You will be automatically entered into the
sweepstakes when you perform any of following tasks on the
CorollaSocialDriver.com site: Registering, sending an invite to a friend (one
entry per party created), posting a photo (one entry per photo), sending a
party reminder (one entry per reminder created), posting in the community area
(one entry per posting), sending a thank you note (one entry per thank you
message), signing up for the weekly mobile tip, or sending a shopping list to
your phone. Or, you may enter via U.S.
mail by legibly writing your name and address on a “3x5” card postmarked by the
Closing Date to Jennifer Toth, RDA Food &
Entertaining, 16 E. 34th Street 14th Floor, New York, NY 10016. To be eligible online entries must be
received by 11:59 p.m. (Eastern Time) on August 18, 2008, and mail in entries
must be postmarked by August 18, 2008, the “Closing Date.” Up to 15 entries per
person per week is permitted. All
entries become the property of the Sponsor(s) and will not be returned. If more than 15 entries are received for any
individual in one week, only the first 15 entries will be included and all
later entries will be disqualified. Each entry has an equal chance to win. All entries must be personally entered by the
individual who is listed as the entrant, and no third party may enter the
sweepstakes on behalf of any person. Any
dispute regarding submission of online entry will be deemed submitted by the
authorized account holder of the email address submitted at the time of
entry. “Authorized account holder” is
defined as the natural person who is assigned to an email address by an
internet access provider, online service provider, or other organizations (e.g.
business, educational institute) that is responsible for assigning email
addresses for the domain associated with the submitted email address. Any
attempt by any participant to obtain more than the stated number of entries by
using multiple/different identities, or any other methods will void that
participant's entry and that participant may be disqualified. Use of any automated system to participate is
prohibited and will result in disqualification.
Sponsors are not responsible for late, lost, illegible, incomplete,
mutilated, and/or stolen entries, which will be disqualified. Sponsor(s), in its sole discretion, reserves the
right to disqualify any person tampering with the operation of the website or
the entry process. 3. PRIZES AND WINNER SELECTION: Grand
Prize: One (1) Grand Prize winner (the “Grand Prize Winner”) will receive a
party for up to 100 guests, including all food and non-alcoholic beverages,
party staff, serving items, paper goods, decoration and clean-up, as chosen in
Sponsor's sole discretion. The Total Approximate Retail Value (ARV) of the
Grand Prize is $3,500. All Grand Prize Winners will be selected by an
independent judging agency whose decisions are final in all respects. The Grand Prize is not transferable cannot be
assigned, substituted or redeemed for cash. Sponsors reserve the right to
substitute a similar prize of equal or greater value in the event that the
stated Grand Prize cannot be awarded due to circumstances beyond the control of
the Sponsor(s). Grand Prize Winner must
provide the location for the party. All taxes, if any are the sole
responsibility of the Grand Prize Winner. Neither the sponsors nor their
affiliates or subsidiaries will be responsible for any loss, liability or
damage arising out of the Grand Prize Winner's acceptance or use of the Grand Prize.
Grand Prize Winner will be selected by random drawing from all eligible entries
on or about August 31, 2008. Odds of
winning depend on the number of eligible entries received. Approximate odds of winning are 1 in 15,000. Bi-weekly
prizes: Ten (10) prizes (“Bi-Weekly Prize(s)”) of gift certificates to
chefscatalog.com will be drawn and awarded every other Friday starting on March
28, 2008 and ending on August 8, 2008. Bi-Weekly Prize winners (“Winners”) will
be selected by random drawing from all eligible entries received during the two
week period prior to each drawing. The Approximate Retail Value (ARV) of the 10
Bi-weekly Prizes is $150 each ($1,500 in total). Approximate odds of winning
are 1 in 1,500. All prize Winners will be selected by an independent judging
agency whose decisions are final in all respects Prizes are not transferable
cannot be assigned, substituted or redeemed for cash. Sponsors reserve the
right to substitute a similar Bi-Weekly Prize of equal or greater value in the
event that any of the stated Bi-Weekly Prizes cannot be awarded due to
circumstances beyond the control of the Sponsor(s). All taxes, if any are the sole
responsibility of the Winner(s). Neither the sponsors nor their affiliates or
subsidiaries will be responsible for any loss, liability or damage arising out
of the Winner's acceptance or use of the Bi-Weekly Prize 4.
WINNER NOTIFICATION: Potential
winners will be notified by email, mail or phone within 30 days of the drawing. Return of Grand Prize/Bi-Weekly prize or Grand
Prize/Bi-Weekly prize notification as undeliverable will result in
disqualification and an alternate winner may be selected. The potential winner
will be required 5.
RELEASE: : By participating, entrant agrees to release and hold harmless the
Sponsors, the Administrator, and their respective parents, subsidiaries,
affiliates, distributors, dealers, dealer advertising associations, advertising
and promotions agencies, prize suppliers and any other agency that provides
services in connection with this Sweepstakes, and each of their respective
officers, directors, employees, representatives, contractors and agents and
successors and assigns (the “Released Parties”) from and against any and all
rights, claims and causes of action whatsoever that they may have, or which may
arise, against any of them for any liability for any matter, cause or thing
whatsoever, including but not limited to any injury, loss, damage, whether
direct, compensatory, incidental or consequential, to person, including death
and property, arising in whole or in part, directly or indirectly, from their
acceptance, possession, use or misuse of the prize in the Sweepstakes, or their
participation in the Sweepstakes, or their participation in any Sweepstakes or
prize related activity, or any travel related to the Sweepstakes or any travel
for any prize-related activity. Winner
also further acknowledges that Sponsors, their affiliates, subsidiaries,
employees, officers, directors, and promotions and advertising agencies have
neither made, nor are in any manner responsible or liable for, any warranty,
representation or guarantee, expressed or implied, in fact or in law, relative
to any prize or the Sweepstakes. 5.
General Conditions: Sponsors reserve the right to cancel, suspend and/or modify
the Sweepstakes, or any part of it, if any fraud, technical failures or any
other factor beyond Sponsors' reasonable control impairs the integrity or
proper functioning of the Sweepstakes, as determined by Sponsors in their sole
discretion. If terminated, Sponsors may,
at their sole discretion, randomly select winners from among all eligible,
non-suspect entries received during the Promotion Period. Sponsors reserve the right in their sole
discretion to disqualify any individual they find to be tampering with the
entry process or the operation of the Sweepstakes or to be acting in violation
of these Official Rules or any other promotion or in an unsportsmanlike or
disruptive manner. Any attempt by any
person to deliberately undermine the legitimate operation of the Sweepstakes
may be a violation of criminal and civil law, and, should such an attempt be
made, Sponsors reserve the right to seek damages from any such person to the
fullest extent permitted by law. Any
failure by Sponsors to enforce any term of these Official Rules or any
applicable laws shall not constitute a waiver of such right. If any provision of these Official Rules is
found by a court of competent jurisdiction to be invalid, then entrant,
Sponsors and the court shall endeavor to give effect to the intent reflected in
that provision, and the remaining Official Rules shall
retain their full force and effect. 6.
Limitations of Liability: The Released Parties are not responsible for: (1) any
incorrect or inaccurate information, whether caused by entrants, printing
errors or by any of the equipment or programming associated with or utilized in
the Sweepstakes; (2) technical failures of any kind, including, but not limited
to malfunctions, interruptions, or disconnections in phone lines or network
hardware or software; (3) unauthorized human intervention in any part of the
entry process or the Sweepstakes; (4) technical or human error which may occur
in the administration of the Sweepstakes or the processing of entries; or (5)
any injury or damage to persons or property which may be caused, directly or
indirectly, in whole or in part, from entrant's participation in the
Sweepstakes or receipt or use or misuse of any prize. If, for any reason, an entrant's entry is
confirmed to have been erroneously deleted, lost, or otherwise destroyed or
corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided
that if it is not possible to award another entry due to discontinuance of the
Sweepstakes, or any part of it, for any reason, Sponsors, at their discretion,
may elect to hold a random drawing from among all eligible entries received up
to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will
be awarded. In the event that
production, technical, seeding, programming or any other reasons cause more
than the stated number of prizes as set forth in these Official Rules to be
available and/or claimed
Sponsors reserve the right to award only the stated number of
prizes by a random drawing among all legitimate, un-awarded, eligible prize
claims. 7. Disputes: Participant
agrees that (1) any and all disputes, claims, and causes of action arising out
of, or connected with, this Sweepstakes (including without limitation, any
alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these
Official Rules (or any part thereof) are invalid, illegal, or otherwise
voidable (or void)) shall be resolved individually, without resort to any form
of class action, and exclusively by arbitration to be held solely in New York,
New York under the auspices of the American Arbitration Association and
pursuant to its Commercial Dispute Resolution Rules and Procedures; (2) any and
all claims, judgments, liabilities, and/or awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with participant's
participation in this Sweepstakes or otherwise accessing this Sweepstakes, but
in no event attorneys' fees; and (3) under no circumstances will you be
permitted to obtain awards for, and participant hereby waives, all rights to
claim, punitive, special, incidental, and/or consequential damages and any
other damages, other than out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF
LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY
TO YOU. Judgment upon the arbitration
award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to
be self-executing, and in the event that either party fails to appear at any
properly noticed arbitration proceeding, an award may be entered against such
party notwithstanding said failure to appear.
In no event shall participant seek or be entitled to rescission,
injunctive, or other equitable relief or to enjoin or restrain the operation of
this Sweepstakes, exploitation of any advertising or other materials issued in
connection therewith, or exploitation of this Sweepstakes or any content or
other material used or displayed on this Sweepstakes. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of the entrant and Sponsors in connection
with the Sweepstakes, shall be governed by, and construed in accordance with,
the laws of the State of New York, without giving effect to any choice of law
or conflict of law rules (whether of the State of New York or any other
jurisdiction), which would cause the application of the laws of any
jurisdiction other than the State of New York. 8.
CONSUMER INFORMATION: Reader's Digest may share customer information about you
with reputable companies in order for them to offer you products and services
of interest to you. If you would rather
we not share information, wish to receive a list of winners, a copy of the
Official Rules, have any questions about the Sweepstakes, or you do not want to
receive future sweepstakes or skill contest mailings from Reader's Digest,
